Newsletter Terms and Conditions
§1 General Provisions
1. The newsletter service is provided by:
- Agnieszka Michalska, conducting business activity under the name SAPO AGNIESZKA MICHALSKA – civil law partnership partner, NIP: 5832529044, REGON: 191721292, and
- Damian Michalski, conducting business activity under the name SAPO Damian Michalski – civil law partnership partner, NIP: 7721897834, REGON: 369100164, operating jointly within a civil law partnership under the name SAPO AGNIESZKA MICHALSKA DAMIAN MICHALSKI SPÓŁKA CYWILNA, with its registered office in Gdańsk (Opacka 22/5, 80-338 Gdańsk), NIP: 5842731646, REGON: 221883971.

§2 Definitions
1. Client/User – an entity that intends to subscribe to the Newsletter Service or purchases products; a natural person with full legal capacity, or in cases provided for by law, a natural person with limited legal capacity, a legal person, or an organizational unit without legal personality granted legal capacity by law, who has entered into or intends to enter into an Agreement with the Service Provider.
2. Consumer – a natural person making a purchase for purposes not directly related to their business or professional activity.
3. Newsletter – a type of online bulletin sent periodically to interested Users. The Newsletter Service consists of delivering to subscribed Users, via email to the address provided during registration, current information about the Service Provider’s products, services, news, updates, promotions, and other content relevant to the Client. The service is provided free of charge and for an indefinite period of time.
4. Privacy Policy – a document or subpage of the Website defining the rules for processing personal data, available at: http://alexlovescolour.pl/pages/privacy-policy
5. Entrepreneur – a natural person, legal person, or organizational unit without legal personality granted legal capacity by law, conducting business activity in their own name and using the Store.
6. Entrepreneur with Consumer Rights – a natural person concluding an agreement directly related to their business activity, where the agreement does not have a professional character for that person, as resulting in particular from the subject of their business activity disclosed in CEIDG.
7. Distance Agreement – an agreement concluded within an organized system of distance contracting, without the simultaneous physical presence of the parties, using exclusively one or more means of distance communication up to and including the moment of concluding the agreement.
8. Electronic Service – a service provided electronically via the Website, within the meaning of Article 2(4) of the Act on Providing Services by Electronic Means.
9. Terms and Conditions – these Newsletter Terms and Conditions.
10. Service Provider – the entities indicated in §1(1).
11. Agreement – mutual arrangements between the Service Provider and the Client specifying their respective rights and obligations.
12. Offer – digital content or other goods provided to the Client in exchange for subscribing to the Newsletter. Detailed terms of the Offer are presented on the Website.
13. Website – the website alexlovescolour.pl, within which the Newsletter subscription is conducted.
§3 Rules of Cooperation and Conclusion of the Agreement
1. The rules of cooperation and terms of performance of the Agreement are set out in these Terms and Conditions and the Offer.
2. Prior to using the Newsletter Service, the Client is provided with these Terms and Conditions free of charge at the bottom of the Website. The Client may save, download, or print the Terms and Conditions at any time.
3. The Client may not use the Newsletter Service using incorrect personal data, anonymously, or under a pseudonym.
4. These Terms and Conditions do not exclude or limit the rights of the Client who is a Consumer or an Entrepreneur with Consumer Rights arising from mandatory provisions of law.
5. The Agreement is concluded upon the Client’s acceptance of these Terms and Conditions, subject to the provisions below.
6. By subscribing to the Newsletter, the Client may receive access to the Offer in accordance with the proposal presented on the Website.
§4 Technical Requirements
1. The Client may use the Newsletter Service in accordance with these Terms and Conditions and applicable law.
2. The Service Provider declares that the public nature of the Internet may involve risks related to unauthorized access or modification of Users’ data; therefore, Users should apply appropriate technical measures to minimize such risks.
3. To use the Newsletter Service, the Client must have:
- an up-to-date web browser with Internet access (e.g. Opera, Mozilla Firefox, Google Chrome);
- an active email account;
- software supporting electronic files in the formats specified in the Offer (e.g. *.zip, *.pdf, *.mobi, *.pub, *.doc, *.docx, *.xls);
- recommended minimum screen resolution: 1024x768;
- cookies and JavaScript enabled in the browser.
4. If additional technical requirements are necessary, the Client will be informed before using the Newsletter Service.
§5 Registration
1. Registration for the service is equivalent to acceptance of these Terms and Conditions and the Privacy Policy.
2. By means of the Website, the Service Provider enables the User to conclude an agreement for the provision of digital content in the form of a Newsletter, free of charge, in exchange for providing personal data and consent to receive the Newsletter.
3. If the User does not wish to provide consent, the Newsletter may be purchased for a fee, subject to individual contact with the Service Provider.
4. To register for the Newsletter, the User must:
- complete the registration form by providing an email address;
- accept these Terms and Conditions;
- accept the Privacy Policy;
- consent to receiving the Newsletter as commercial information;
- confirm the subscription via a confirmation link sent to the provided email address.
5. Consent is voluntary, but without it the Newsletter Service cannot be provided.
6. Registration results in adding the User’s email address to the mailing list for Newsletter distribution.
§6 Complaints
1. Complaints regarding the Newsletter Service may be submitted:
- in writing to the Service Provider’s address, or
- by email to: info@sapo.pl.
2. The complaint should include a clear description of the issue, the User’s request, and their data.
3. The Service Provider shall respond within 14 days of receipt of the complaint.
§7 Personal Data
1. Personal data provided by Users is processed by the Service Provider.
2. Providing personal data is voluntary but necessary to provide the Newsletter Service.
3. The User has the right to access, correct, and delete their personal data.

5. Personal data may be transferred to entities providing newsletter mailing services.
§8 Withdrawal from the Agreement
1. This section defines the rules for withdrawal by Consumers and Entrepreneurs with Consumer Rights.
2. The Client has the right to withdraw from the Agreement within 14 days by submitting a clear statement (e.g. email or letter).
§9 Amendments to the Terms and Conditions
1. The Service Provider reserves the right to amend the Terms and Conditions only for valid reasons. Valid reasons shall be understood as the necessity to amend the Terms and Conditions resulting from:
- changes to the functionality of the Newsletter requiring modification of the Terms and Conditions, or
- changes in legal regulations affecting the performance of the Agreement by the Service Provider, or the need to adapt the services to recommendations, guidelines, orders or prohibitions, rulings, decisions, interpretations or other acts of competent public authorities, or
- changes to the contact or identification details of the Service Provider.
2. Information about the planned amendment to the Terms and Conditions shall be sent to the User’s email address provided at the time of concluding the Agreement at least 7 days prior to the effective date of the changes.
3. If the User does not object to the planned changes before they enter into force, it shall be deemed that the User has accepted them, which shall not prevent the User from terminating the Agreement in the future.
4. In the event of no acceptance of the planned changes, the User should notify the Service Provider by sending an email to info@sapo.pl, which shall result in termination of the Agreement as of the date the planned changes enter into force.
5. The Service Provider may make changes to the Newsletter that are not necessary to maintain its conformity with the Agreement due to changes in the Newsletter’s functionality. The introduction of such changes shall not entail any costs for the User.
6. If a change referred to in the preceding provision materially and adversely affects the User’s access to the Newsletter or the use thereof, the Service Provider shall, in advance and on a durable medium, inform the User by email about the characteristics and date of the change, as well as the rights to which the privileged User is entitled in connection with such change.
§10 Final Provisions
1. During the occurrence of force majeure, the Parties to the Agreement shall be released from any liability for non-performance or improper performance of the Agreement, provided that the circumstances of force majeure constitute an obstacle to the performance of the Agreement. The above shall also apply to the period immediately preceding or following the occurrence of force majeure, provided that during such period the effects of force majeure constitute an obstacle to the performance of the Agreement.
2. “Force majeure” shall mean a sudden or natural event beyond the control and will of the Parties, which could not have been foreseen and whose effects could not have been prevented, including in particular events such as floods, war, acts of terrorism, or the declaration of a state of emergency.
3. When using the Newsletter Service, it is prohibited to act in a manner contrary to the law, good morals, or that infringes the personal rights of third parties, as well as to provide information of an unlawful nature.
4. Amicable dispute resolution and handling of complaints. The Consumer may seek assistance from:
- a permanent consumer arbitration court to resolve a dispute arising from the concluded agreement;
- a provincial inspector of the Trade Inspection Authority to initiate mediation proceedings aimed at an amicable resolution of the dispute between the Client and the Service Provider;
- a district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection, in order to obtain assistance regarding the agreement; or may use the ODR platform, which serves to resolve disputes between consumers and entrepreneurs: http://ec.europa.eu/consumers/odr
5. The governing law shall be Polish law, subject to paragraph 8.
6. The competent court shall be a Polish court, subject to paragraph 8.
7. In the case of a Client who is a Consumer, the provisions of these Terms and Conditions shall not deprive the Consumer of the protection granted by the mandatory provisions of the law of the country of the Consumer’s habitual residence, which cannot be excluded by agreement. If the provisions of the law applicable in the Consumer’s country are more favorable to the Consumer and cannot be excluded by agreement, such provisions shall apply to the agreement concluded between the Client and the Service Provider.
8. These Terms and Conditions shall enter into force on 5 January 2026.
§11 Copyright and Licenses
1. All materials made available by the Service Provider, including electronic Products and Services, photographs, texts, graphics, multimedia content and trademarks, constitute works within the meaning of the Act on Copyright and Related Rights and are subject to legal protection.
2. Copyright to the above-mentioned materials is held by the Service Provider or by another entity from whom the Service Provider has obtained an appropriate
license. The materials may also be used by the Service Provider on the basis of another legal title.
3. All materials made available by the Service Provider may be used by the Client solely for personal use, unless otherwise specified in the Offer. Any further distribution, sharing, copying, downloading, or use of the materials in any manner beyond the scope of permitted use is prohibited.
4. The Service Provider grants the Client a non-exclusive license, without the right to grant sublicenses and without territorial limitations. Any time limitations result from the Offer or these Terms and Conditions. The remuneration for granting the license has been included in the price.
5. The Client is entitled to use the materials within the following fields of exploitation:
- fixation and reproduction of the work — producing copies of the work using any technique, including printing, reprographic, magnetic recording and digital techniques;
- distribution of the original or copies on which the work has been fixed — placing on the market, lending or renting the original or copies;
- dissemination of the work in a manner other than specified above — public performance, exhibition, display, playback, broadcasting and rebroadcasting, as well as making the work publicly available in such a way that anyone may access it at a place and time individually chosen by them.
6. In the event of a breach of the prohibitions referred to in this section, including infringement of copyright, the Service Provider shall be entitled to seek compensation and damages from the Client. The Client may incur civil or criminal liability in this respect.
7. The Service Provider reserves the right to periodically update the Products, including in particular electronic Products.
